Authorizes the Nebraska Department of Transportation to establish, use, and operate a mitigation bank or in-lieu fee program for compensatory mitigation of incidental take of threatened or endangered species and their habitat from permitted activities

Requires state regulatory agencies to make good faith efforts to prioritize using the Department of Transportation's mitigation bank when reviewing mitigation plans for permitted state transportation projects

Grants the Department of Transportation authority to acquire real property through purchase, bequest, donation, or eminent domain for use with the mitigation program

Allows the Department to enter cooperative agreements with state, local, or private parties and to restore, create, enhance, or preserve suitable habitat for threatened and endangered species

Requires any state, local, or private party that owns mitigation bank land to pay a sum in lieu of ad valorem taxes lost by the county
