Amends Nebraska's Uniform Controlled Substances Act (section 28-416) to add a new penalty enhancement trigger when a controlled substance violation results in the use of the substance and directly causes death or serious bodily injury to another person

Penalty enhancement raises the offense to the next higher felony classification than what would otherwise apply based on the drug type and quantity involved

Enhanced penalties are capped at Class IB felony regardless of the underlying offense classification

Restructures existing penalty enhancement provision for possessing a firearm during a drug violation into the same subsection (16) alongside the new serious bodily injury/death enhancement
