First class cities and second class cities/villages may exempt certain farm buildings from zoning regulations, property use regulations, building ordinances, electrical ordinances, and plumbing ordinances within their extraterritorial zoning jurisdiction through board of adjustment action

Farm buildings qualify for exemption if they are used for agricultural purposes on a farmstead of 20 acres or more that produces $1,000 or more of farm products annually

Exemptions require that farm building structures be consistent with the comprehensive development plan, including anticipated long-range future growth based on documented population and economic projections

Approved by the Governor on May 21, 2025 and introduced by Senator Andersen (District 49)
