Appeals of conditional use or special exception decisions require the appealing party to prove by clear and convincing evidence that the decision was arbitrary, capricious, illegal, or did not adhere to county zoning regulations

Planning commissions have 30 days to determine if applications are complete and must act within 90 days of receiving a complete application; county boards also have 90 days to decide after receiving commission recommendations

Conditional use permits or special exceptions are automatically deemed granted if the county board fails to act within the 90-day decision period

When evaluating conditional use or special exception applications, commissions and boards must presume applicants will comply with all local, state, and federal requirements, with the burden of proof resting on any party challenging that presumption
