Law enforcement agencies, jails, and the Nebraska State Patrol must receive approval from their local governing body or the Nebraska Commission on Law Enforcement and Criminal Justice before entering immigration enforcement agreements, effective July 1, 2026

Written notice must be provided at least 30 days before any proposed immigration enforcement agreement takes effect, and the agreement must be placed on the agenda of a public meeting where residents can attend and speak

Existing immigration enforcement agreements entered before July 1, 2026 automatically terminate on December 1, 2026 unless agencies provide notice by October 15, 2026 and receive approval through the public hearing process

Human trafficking investigations and enforcement agreements with the Department of Homeland Security are explicitly exempted from these requirements

Violations are treated as Open Meetings Act violations, and any Nebraska resident may file a civil action in district court to require compliance; agreements entered without proper approval are void and unenforceable
