Expands the existing crime of using a scanning device or reencoder to defraud by including integrated circuit chips (EMV chips) in addition to magnetic strips on payment cards

Makes it illegal to use a scanning device to access, read, or store information from a payment card's integrated circuit chip without authorization and with intent to defraud

Prohibits using a reencoder to transfer information from one card's integrated circuit chip onto another card's chip without permission and with fraudulent intent

Effective date is January 1, 2027

Fiscal impact includes indeterminable state expenditures from the General Fund and indeterminable county/local expenditures due to potential changes in prosecution and incarceration costs
