Physicians receiving more than $5,000 in aggregate compensation within a calendar year from a single source through "preferential promotions" must disclose this financial relationship to patients before recommending related products or services

"Preferential promotion" is defined as any financial arrangement from manufacturers, distributors, or third parties intended to influence prescription or use of specific drugs, devices, treatments, or services

"Compensation" broadly includes payments, honoraria, travel, lodging, meals, gifts, or any other transfer of value

Required written disclosure must include the entity's name, nature and amount of compensation, a conflict of interest statement, and an affirmation that the recommendation is based on independent clinical judgment
