Creates a new chapter (RSA 461-C) establishing "Caregiver Authorization Affidavits" that allow parents, legal guardians, or legal custodians to authorize a designated adult caregiver to make education and health care decisions for a minor without transferring guardianship

Caregivers granted authority may consent to medical, dental, and mental health treatment; access health care records and insurance information; and make all educational decisions including enrollment, special education matters, and signing permission slips

The affidavit must be signed under penalty of perjury, witnessed by two adults (not the caregiver), and notarized; it is valid for up to 2 years and can be reauthorized, amended, or revoked in writing

The authorizing party's decisions supersede the caregiver's decisions in case of conflict, and the affidavit cannot divest the parent of their rights or be used to circumvent laws, manipulate school attendance, or restore rights removed by court order

Effective date is January 1, 2027
