Retail establishments with employee-only restrooms must allow customers with eligible medical conditions (Crohn's disease, ulcerative colitis, inflammatory bowel disease, irritable bowel syndrome, or conditions requiring ostomy devices) to use the restroom during normal business hours

Access requirements apply only when three or more employees are working, no public restroom is available to the customer, and the restroom can be safely accessed without health, safety, or security risks

Small filling stations or service stations (800 square feet or less) are exempt from the requirements

Retail establishments and employees are shielded from civil liability for injuries or deaths occurring when allowing restroom access, unless the act was willful or grossly negligent

Violations constitute a petty disorderly persons offense punishable by fines up to $500 per violation, enforced by the Department of Health or local health boards
