Upgrades the crime of using a scanning device or reencoder to defraud payment card users from a third-degree to a second-degree offense when a subsequent offense results in theft of at least $50,000 or when combined offenses total $50,000 or more

Increases penalties for possessing scanning or reencoding equipment with intent to commit fraud from a fourth-degree crime for first offenses to a third-degree crime for second or subsequent offenses

Requires merchants accepting payment cards in New Jersey to implement reasonable security measures to prevent skimming at payment terminals, including regular terminal inspections, employee training, security cameras, and antivirus/encryption software

Directs the Director of the Division of Consumer Affairs to adopt rules and regulations establishing merchant security requirements and to provide guidance and best practices materials

Takes effect 365 days after enactment to allow time for regulatory implementation and merchant compliance
