Prohibits the sale, offer for sale, or distribution of nail polish or nail hardener containing dibutyl phthalates, toluene, or formaldehyde in New Jersey

Requires sellers, distributors, and the Director of Consumer Affairs to issue immediate recalls for nail products containing these banned chemicals

Retail establishments must remove recalled products from displays within 48 hours of receiving notice and return inventory to sellers/distributors within 14 business days at the seller's cost

Sellers and distributors must dispose of recalled products within 60 business days in a manner that prevents public access and complies with applicable disposal laws

Knowing violations constitute an unlawful practice under the Consumer Fraud Act, punishable by up to $10,000 for first offense and $20,000 for subsequent offenses, plus potential cease and desist orders and treble damages
