Removes the exemption that currently allows practitioners to refer patients to intraoperative monitoring services during neurosurgical, neurological, or neuro-radiological procedures in hospitals when the practitioner has a financial interest in that service

New Jersey law generally prohibits practitioners from referring patients to health care services in which the practitioner or their immediate family has a significant beneficial interest

The change means practitioners with ownership interests in intraoperative monitoring services will no longer be able to refer their own surgical patients to those services

Other exemptions remain in place, including for in-office procedures, renal dialysis, ambulatory surgery where the practitioner personally performs the procedure, and value-based payment arrangements

Takes effect immediately upon enactment
