Municipal governing bodies may delegate authority to their municipal clerk, by ordinance, to provide written statements in support of affordable housing programs or projects on the governing body's behalf

The delegation applies when proposed affordable housing conforms to a municipal fair share plan and housing element approved through a judgment of repose, compliance, or other judicial or state administrative certification

Amends the New Jersey Affordable Housing Trust Fund requirements to allow programs and projects to be funded upon receipt of either a governing body statement or a municipal clerk statement (if the delegation ordinance is enacted)

Amends New Jersey Housing and Mortgage Finance Agency loan application requirements to accept either a municipal resolution or a municipal clerk's written statement indicating need for housing projects with below-market-rate rental units

Effective immediately upon approval on March 20, 2024
