Medicaid managed care organizations (MCOs) must allow all New Jersey pharmacies to dispense prescriptions for all covered medications, regardless of medication cost or other carrier-developed criteria

Pharmacies must accept MCO plan terms and conditions to participate, but cannot be required to dispense medications below their acquisition cost

MCO enrollees may choose any qualified pharmacy that is a contracting provider, and no pharmacy can be denied the right to become a contracting provider if it accepts the contract terms

MCOs are prohibited from imposing copayments, fees, or conditions on enrollees selecting one pharmacy that are not equally applied to enrollees selecting any other qualified pharmacy

Takes effect on the first day of the seventh month following enactment and applies to Medicaid managed care contracts executed on or after that date
