Upgrades causing or permitting a child to engage in photographed sexual acts from a second degree to a first degree crime for all offenders, not just parents and guardians

Creates new crime of "virtual" child pornography for computer-generated images that appear to depict children in obscene sexual acts, with second degree penalties for production and distribution, and third degree penalties for possession

Increases possession of child pornography from a fourth degree to a third degree crime, and establishes rebuttable presumptions that persons appearing to be children in images are actual children under age 16

Requires mandatory minimum prison sentences of one-third to one-half of the imposed term for repeat offenders previously convicted of sex crimes including sexual assault, luring or enticing a child, or other child endangerment offenses

Allows hearsay evidence to prove the existence, identity, and age of child victims depicted in pornography, and requires defendants claiming images were not created using actual children to provide advance notice to prosecutors
