Theft of a firearm currently carries a penalty of 3-5 years imprisonment, a fine of up to $15,000, or both

Under existing law, first-time offenders of most third and fourth degree crimes receive probation rather than imprisonment due to a presumption of non-imprisonment

Adds theft of a firearm to the list of third-degree crimes (which already includes theft of a motor vehicle, unlawful taking of a motor vehicle, and eluding) where judges are not bound by the presumption against incarceration

The bill takes effect immediately upon enactment
