Criminalizes payments, kickbacks, bribes, or rebates made in connection with referring patients to substance use disorder treatment facilities, recovery residences, or clinical laboratories as a third-degree offense with mandatory restitution and $50,000 fine

Applies criminal penalties to those who knowingly assist, conspire with, or urge others to make or receive prohibited referral payments

Creates exemptions for payments that do not vary based on number of patients referred, duration or volume of treatment services, or amount of insurance benefits provided

Authorizes the Department of Health to investigate and penalize licensed health care facilities and clinical laboratories up to $20,000 per violation, including license suspension or revocation

Authorizes the Department of Community Affairs to investigate recovery residences and impose civil penalties up to $20,000 per violation against recovery residence owners
