Recklessly discharging a firearm unlawfully or without lawful purpose within 100 yards of an occupied structure, school, college, university, school bus, or child care facility constitutes a third degree crime, punishable by 3-5 years imprisonment and/or up to $15,000 fine

Reckless discharge of a firearm in other locations constitutes a fourth degree crime, punishable by up to 18 months imprisonment and/or up to $10,000 fine

"Structure" is defined broadly to include buildings, rooms, ships, vessels, cars, vehicles, airplanes, places for overnight accommodation, or places for conducting business

Convictions under this law cannot merge with other related convictions, requiring separate sentences for each offense

Multiple sentences of imprisonment for related offenses must run consecutively rather than concurrently, implementing recommendation #3 from the September 2024 NJ State Commission of Investigation report on illegal firearms
