Recklessly discharging a firearm with live ammunition unlawfully or without lawful purpose is a disorderly persons offense for a first conviction, a fourth-degree crime for a second conviction, and a third-degree crime for third or subsequent convictions

Penalties are enhanced by one degree when the reckless discharge occurs within 100 yards of an occupied structure, school, college, university, school bus, or child care facility (whether occupied or not)

Convictions under this law cannot merge with other related convictions, and separate sentences must be imposed for each conviction

Multiple sentences of imprisonment for offenses under this law must run consecutively rather than concurrently

Lawful self-defense is an affirmative defense to prosecution under this law
