State-funded construction projects carried out by governmental entities must use plastic construction materials containing at least 10% postconsumer recycled content starting one year after enactment, increasing to 15% after two years

Plastic construction materials are defined as those made of greater than 50% plastic by cost; road surface materials and traffic signs/signage are excluded from requirements

Exemptions apply when compliant materials would increase overall project costs by 20% or more, when suitable materials don't exist or aren't available in sufficient quantities within 60 days of construction start, or when a licensed architect/engineer certifies structural integrity concerns

Construction of deed-restricted low-income or moderate-income housing is exempt from the recycled content requirements

The Commissioner of Environmental Protection is authorized to adopt rules and regulations to implement the act
