Electric public utilities must file tariff applications with the Board of Public Utilities within 180 days to establish special rates for "large load customers," defined as commercial customers with aggregate monthly demand exceeding 100 megawatts.

Tariffs must ensure other utility customers do not subsidize large load customers and that all costs attributable to serving these customers are assigned directly to them.

New large load customers must provide financial guarantees to pay for at least 85% of requested service for a minimum of 10 years and demonstrate their project is not duplicative of other large load projects.

Utilities must require deposits or financial security sufficient to protect ratepayers if the large load customer ceases operations or uses less service than anticipated during the 10-year period.

Tariffs must incentivize large load customers to increase energy efficiency, including using technologies that capture and utilize heat produced by their facilities.
