Workers on data center construction projects designed to use 5 megawatts or greater annually must be paid prevailing wage rates as determined by the Commissioner of Labor and Workforce Development

Contractors must be registered under the Public Works Contractor Registration Act, maintain a workers' compensation experience modifier rate of 0.95 or lower, and carry at least $2 million in general liability and motor vehicle insurance per occurrence

All workers must complete OSHA-10 safety training, with at least one supervisor completing OSHA-30 training, and one OSHA-30 certified worker required for every 15 employees on site

Data center projects designed for 25 megawatts or greater annual usage may include a project labor agreement with labor organizations that serve as the basis for prevailing wage determinations

Contractors are jointly and severally liable for unpaid wages owed by subcontractors, and must provide performance and payment bonds of at least 150% of contract value
