Requires developers of offshore wind projects to obtain written approval from local government bodies before constructing, installing, or maintaining wires, conduits, lines, and associated infrastructure on public streets, thoroughfares, or rights-of-way

Developers seeking easements or property rights on local government-owned land must petition the Board of Public Utilities, which must hold a public hearing and issue a recommendation within 90 days; the local government then has 90 days to approve or disapprove the request

Developers must pay all costs of infrastructure installation, maintenance, and reimbursement for the Board and local government's review expenses

Repeals provisions from P.L.2021, c.178 that gave the BPU authority to approve offshore wind property acquisitions and preempt local approvals, effectively eliminating state override powers for offshore wind projects

Removes the designation of offshore wind projects as electric power generators exempt from municipal land use law requirements
