Allows certain licensed or regulated professionals to be classified as independent contractors rather than employees under all New Jersey laws if they have a written agreement describing them as such

Applies to licensed insurance producers, broker-dealers, investment advisers, investment adviser representatives registered with state or federal securities regulators, and motor vehicle operators who deliver freight from marine terminals or rail facilities

Exempts these professionals from having to satisfy additional tests for independent contractor status, including the ABC test used under state wage payment and wage and hour laws

Applies retroactively to any written agreements entered into before or after the bill's effective date, confirming the legislative intent that these professionals have not historically been treated as employees

Grants independent contractor classification for the duration of any qualifying written agreement
