Courts may assess rescue operation costs incurred by public entities (law enforcement, emergency medical services) against individuals who require rescue due to their own illegal conduct

Cost recovery applies only when a person is found guilty of both criminal mischief under N.J.S.2C:17-3 and a driving offense (reckless driving, careless driving, or operating a vehicle in an unsafe manner)

Recoverable costs include services, expenses, and costs associated with rescuing the person, their pets, or their property

The assessment is imposed in addition to any other criminal or traffic penalties the person may face

Targets situations such as driving on frozen bodies of water or other reckless vehicle operation that damages property and endangers lives, requiring public rescue resources
