Imposes a mandatory six-month prison term or six months of community service for burglary, robbery, or theft committed during a state of emergency, in addition to existing penalties for those crimes under New Jersey law

Clarifies that violations of the Disaster Control Act apply both during the "threat or imminence" of an emergency and during an "ongoing emergency"

Maintains existing penalties for general Disaster Control Act violations: up to six months imprisonment and/or up to $1,000 fine for disorderly persons offenses

Applies to emergencies declared by the Governor, including war emergencies and natural or unnatural disasters endangering health, safety, or resources of residents

Prosecutions would occur in municipal court with the State required to prove all elements beyond a reasonable doubt
