Municipalities may challenge Council on Affordable Housing (COAH) orders requiring non-redevelopment housing projects on undeveloped land, with the challenge succeeding unless COAH proves the order addresses exclusionary zoning practices

Caps municipal fair share affordable housing allocations at an amount that would increase the municipal population by no more than 5% in any 10-year period, with each housing unit counted as 4 residents (2 for senior units)

Limits the 1,000-unit affordable housing cap to municipalities where that number would represent housing for less than 5% of the population; smaller municipalities receive proportionally lower caps

Excludes flood-prone land from vacant land calculations for affordable housing purposes, including land below federal flood elevation determinations, land below state flood hazard standards, and land within 100 feet of category one waters

Requires the Department of Environmental Protection to adopt regulations guiding flood-prone land determinations within 7 months of enactment
