Proposes amending the New Jersey Constitution to prohibit the State, counties, municipalities, school districts, and other public entities from using eminent domain to take land actively devoted to agricultural or horticultural use

Creates an exception allowing governments to take active farmland through eminent domain only if the property is permanently restricted to continued agricultural or horticultural use in perpetuity

Requires the proposed amendment to be placed on the ballot at the next general election occurring more than three months after legislative approval
