Declares that the New Jersey Department of Environmental Protection's adoption of California's "Advanced Clean Cars II" (ACC II) program rules (published December 18, 2023) is inconsistent with legislative intent

Argues the Legislature only authorized implementation of California's LEV II program under a 2003 law (P.L.2003, c.266), not subsequent more stringent zero-emission vehicle requirements like ACC II

Asserts the DEP Commissioner failed to provide required written notice to legislative committees about the major substantive changes before adopting the ACC II rules

Gives the DEP 30 days from transmittal of the resolution to amend or withdraw the ACC II regulations

Reserves the Legislature's constitutional authority to fully invalidate the regulations through a subsequent concurrent resolution if the DEP does not comply
