Requires individuals not licensed by the New Jersey Real Estate Commission who send text messages soliciting homeowners about selling their homes to first send a separate disclosure text stating they are not a commission licensee, naming their employer, and identifying the message as a solicitation

Establishes penalties of up to $5,000 for first violations and up to $10,000 for subsequent violations, enforced by the Division of Consumer Affairs

Directs the Division of Consumer Affairs to develop a public education program to inform licensed real estate professionals and homeowners about the new requirements and potential fraudulent text solicitation activity

Defines "home" as any attached unit or stand-alone building used as a primary or additional residence, including rental properties

Takes effect on the first day of the seventh month following enactment
