First offense penalties may include fines up to $500, imprisonment up to 90 days, or both; second or subsequent offenses may result in fines up to $2,000, imprisonment up to 90 days, or both.

The Department must develop technical guidance materials for municipalities covering inspection procedures, notification processes for non-compliant owners, and verification methods to ensure compliance.

Standards will be designed to minimize harm to public health, safety, and the environment, considering the location, surroundings, and use of each structure.
