All New Jersey state forms, documents, and applications must collect information about sex, gender, gender identity, and sexual orientation whenever demographic data is collected.

Providing sex, gender, gender identity, and sexual orientation information is optional, and forms must clearly state that services will not be withheld if individuals decline to answer.

Questions must allow for non-binary designations and be posed in a manner consistent with best practices recognized by Garden State Equality and other LGBTQ+ advocacy organizations.

Only the individual (or parent/guardian for minors under 18) has authority to grant or refuse disclosure of their sex, gender, gender identity, or sexual orientation information—not healthcare providers or state employees.

The Secretary of State must adopt implementing regulations, and the law takes effect on the first day of the third month following enactment.
