Governing boards of New Jersey public higher education institutions must notify the Secretary of Higher Education before commencing any institutional merger or consolidation, including mergers of schools within the same institution.

Required notice must include the reason for the proposed merger or consolidation, projected costs with a preliminary fiscal impact assessment, and effects on students and employees.

Notice must be submitted within 14 days of the governing board adopting a resolution or entering an agreement to begin the merger or consolidation process.
