Municipalities hosting sanitary landfills must receive annual economic benefits of at least $1.00 per ton of solid waste accepted, while transfer station host municipalities receive at least $0.50 per ton, payable quarterly.

Negotiations between municipalities and facility operators must be completed within 180 days, with the possibility of one 180-day extension if both parties jointly apply and demonstrate good-faith negotiating.

Municipalities must publish proposed annual economic benefits online for a minimum 45-day public comment period before submitting agreements to the Department of Environmental Protection or Board of Public Utilities for approval.

If negotiations fail due to bad faith by either party or inability to reach agreement within allowed timeframes, the DEP or BPU must issue an order establishing the annual economic benefit.

Any resident of a host municipality may petition the DEP or BPU to establish or adjust an annual economic benefit, with the agency required to decide within 180 days of receiving the petition.
