Unauthorized access or use of automated license plate reader data by law enforcement employees constitutes a disorderly persons offense, punishable by up to six months imprisonment, a fine up to $1,000, or both.

County prosecutors or the Attorney General must conduct annual audits of every law enforcement agency's use of license plate readers to ensure data is used only for legitimate law enforcement purposes.

Law enforcement agencies using license plate readers must submit annual reports to the Attorney General detailing the number of devices operated, readings made, data stored, requests received (including out-of-state and federal), data breaches, and audit results.

License plate reader data must be retained for two years and then purged, though agencies may request early deletion from the Division of Criminal Justice Director to reduce storage costs.

Takes effect on the first day of the seventh month after enactment.
