State-funded construction projects in New Jersey must use plastic construction materials containing at least 10% postconsumer recycled content starting one year after enactment, increasing to 15% after two years.

"Plastic construction material" is defined as any construction material made of greater than 50% plastic by cost, excluding road surface materials and traffic signs/markings.

Exemptions apply when compliant materials would increase project costs by 20% or more, when compliant materials are unavailable for the application or within 60 days of construction start, or when a licensed architect/engineer certifies structural safety concerns.

Deed-restricted low-income and moderate-income housing construction projects are exempt from the recycled content requirements.

The Commissioner of Environmental Protection is authorized to adopt implementing regulations under the Administrative Procedure Act.
