Persons or entities that sell, transfer, disclose, or provide data to foreign adversaries are barred from State contracts, subcontracts, public works registrations, economic development subsidies, tax abatements, tax clearance certificates, urban renewal certifications, and redeveloper designations

Department of the Treasury must create and maintain a public list of entities that share data with foreign adversaries, updating it at least every six months, with notice and opportunity to respond before inclusion

Entities seeking State contracts must certify they are not on the restricted list; false certification results in civil penalties of $1,000,000 or twice the contract amount (whichever is greater), contract termination, and five-year ineligibility

State agencies are prohibited from banking with, investing in, or holding insurance policies from financial institutions identified as sharing data with foreign adversaries

Exemptions apply for data shared pursuant to lawful subpoenas, legitimate international business transactions consistent with U.S. export laws, and publicly available data without personally identifiable information or trade secrets
