Requires public schools with 5% or more students eligible for free or reduced price meals to establish school breakfast programs, lowering the current 20% eligibility threshold under existing New Jersey law.

Schools serving pre-K through 6th grade must implement breakfast programs by September 1, 2023; schools serving other grades must implement by September 1, 2024.

School districts must submit breakfast program plans to the Department of Agriculture for review; districts failing to submit plans must adopt a model plan provided by the department.

The Department of Agriculture may grant one-year waivers to schools lacking staff, facilities, equipment, or funding to implement the program, provided districts submit justification and remediation plans.

Requires annual state appropriations to the Department of Agriculture to fund the state's share of school breakfast program costs.
