Food and beverage establishments may seat patrons in open air spaces with fixed roofs or temporary awnings/covers that have at least two open sides for egress, provided the covering is anchored, staked, or fastened

Establishments cannot seat patrons under roofs, awnings, or covers with more than two inches of accumulated snow unless the structure is certified to hold a snow load under N.J.A.C. Title 5, Chapter 23

Applies to restaurants, cafeterias, dining establishments, food courts, bars, and liquor license holders with retail consumption privileges, regardless of whether they hold a liquor license

Exempts restaurants from certain snow certification requirements during the COVID-19 pandemic

The bill expires upon the expiration of Executive Order No. 103 or any extension or replacement thereof
