Licensed outpatient substance use disorder treatment programs in New Jersey may lease, manage, and own housing units while concurrently providing treatment services and transportation to individuals needing both treatment and housing

Housing must be provided under a separate contract from treatment services, with the contract stating the individual acknowledges responsibility to repay any housing discounts or subsidies

Individuals must be advised that housing and treatment services are not contingent on each other and can be received separately and independently

Treatment programs and their owners, officers, or directors are prohibited from providing or receiving remuneration for referrals of persons seeking substance use disorder treatment

The Commissioner of Human Services may promulgate rules to implement the act, and all housing offered must comply with state and local zoning and safety laws
