Insurers offering commercial general liability insurance must provide a clear statement on a separate page indicating whether the policy covers liability for transmission of communicable diseases, including COVID-19.

If a policy excludes communicable disease coverage, the insurer must disclose either the cost to remove the exclusion or a statement that coverage may be purchased from another insurer.

Failure to provide the required disclosure renders any communicable disease exclusion invalid, and the policy is deemed to provide liability coverage for disease transmission.

The notification requirement applies to both new policy purchasers and policyholders seeking renewal.

The law takes effect 30 days after enactment.
