Amends Article VIII, Section III of the New Jersey Constitution to prohibit the State, municipalities, and other public or private corporations from using eminent domain to take land actively devoted to agricultural or horticultural use

Creates an exception allowing eminent domain acquisition of active farmland only if the property is restricted in perpetuity to continued agricultural or horticultural use

Applies to all levels of government including the State, counties, municipalities, school districts, and local public entities, as well as private entities to whom eminent domain powers may be delegated

Requires voter approval at a general election occurring more than three months after final legislative agreement, with the amendment published in at least one newspaper per county at least three months prior to the election
