Retail cigarette and vapor product dealers must be inspected at least twice annually by officials authorized by the Attorney General or Commissioner of Health, including county or municipal law enforcement agencies.

Follow-up inspections are required within three months after any violation is detected at a retail location.

Cigarettes and vapor products found in violation may be declared contraband goods and subject to seizure, disposal, or destruction when ordered by the Attorney General or Commissioner of Health.

Civil penalties for flavored cigarette violations range from $250 (first offense) to $1,000 (third and subsequent offenses); flavored vapor product violations range from $500 to $2,000.

Penalties collected from violations are paid into the municipal treasury where the violation occurred for general municipal use.
