Data center construction projects with electrical capacity of 5 megawatts or greater annually must pay workers the prevailing wage rate as determined by the Commissioner of Labor and Workforce Development.

Contractors must be registered under the Public Works Contractor Registration Act, submit certified payroll records, carry at least $2 million in general liability insurance, and provide a performance bond of at least 150% of contract value.

Contractors are jointly and severally liable for unpaid wages and benefits owed by subcontractors, and temporary workers may only be used if enrolled in registered apprenticeship programs.

All workers must complete OSHA-10 training, at least one supervisor must have OSHA-30 certification, and all workers must undergo drug testing.

Data center projects of 25 megawatts or greater may include project labor agreements with labor organizations when determined to advance state and community interests in energy efficiency, quality, safety, and workforce development.
