Retail establishments with employee-only restrooms must allow access to customers with eligible medical conditions including Crohn's disease, ulcerative colitis, inflammatory bowel disease, irritable bowel syndrome, or conditions requiring ostomy devices

Access requirements apply only when three or more employees are working, no public restroom is available, and the employee restroom can be safely accessed without health or security risks

Retail establishments and employees are shielded from civil liability for injuries occurring when allowing customer restroom access, unless the act was willful or grossly negligent

Violations constitute a petty disorderly persons offense with fines up to $500 per incident, enforceable by the Department of Health or local health boards

Small filling stations or service stations (800 square feet or less) with employee restrooms are exempt from the requirements
