Municipalities would receive one unit of credit toward their fair share affordable housing obligation for each bedroom in a community residence, which includes group homes, halfway houses, supervised apartments, and hostels serving individuals with special needs.

Housing units restricted for very low income households would count as two units toward a municipality's fair share obligation.

Special needs housing project units would also receive double credit, counting as two units toward the fair share requirement.

Community residences are defined as shared living environments providing housing and treatment services for individuals with special needs, excluding health care facilities.

The bill amends the 1985 Fair Housing Act (P.L.1985, c.222) and would take effect immediately upon enactment.
