Creates the new crime of "gang shoplifting" when a person, acting with one or more others, enters a store and openly takes merchandise without paying or tampers with property in a way that endangers people or damages the premises

Classifies gang shoplifting as a third-degree crime, punishable by 3-5 years imprisonment and/or fines up to $15,000

Requires a mandatory minimum prison sentence of at least one year with no parole eligibility during that period, overriding standard presumptions against imprisonment for certain offenders

Prohibits merger of this conviction with any other criminal offense, meaning defendants can be sentenced separately for gang shoplifting and any related charges

Targets organized retail theft incidents, commonly known as "flash mobs," where groups coordinate to loot stores openly
