Multistory building owners (hotels and multiple dwellings with 2+ floors, excluding owner-occupied buildings with fewer than 4 units) must ensure accessibility for persons with disabilities within 18 months of enactment, including during elevator outages.

Elevator service must be restored within 2 hours of an outage notification; if restoration takes longer or no elevator exists, alternative access methods such as evacuation chairs, ramps, or motorized stairlifts must be provided.

Penalties for violations range from $500 for a first offense to $1,000 for subsequent violations and $2,500 for acute health or safety risks, with each day of continuing violation constituting a separate offense.

The Division of Codes and Standards must establish a grant program to help property owners purchase accessibility equipment and will handle inspections, violation reports, and enforcement.

Property owners experiencing financial hardship or structural limitations may apply for an extension of up to 12 additional months to comply with requirements.
