State-funded construction projects carried out by State, county, or municipal governmental entities must use plastic construction materials containing minimum postconsumer recycled content starting one year after enactment

Recycled content requirements phase in: 10% minimum for the first two years after enactment, increasing to 15% thereafter

"Plastic construction material" is defined as construction material that is more than 50% plastic by cost

Exemptions apply if compliant materials would increase overall project costs by 25% or more, or if compliant materials do not exist or are unavailable in sufficient quantities for the intended application

The Commissioner of Environmental Protection is authorized to adopt rules and regulations to implement the requirements
