Amends N.J.S.2A:15-10 to allow defendants to file a motion for dismissal with prejudice in civil real estate actions where a lis pendens notice was previously discharged due to the plaintiff's failure to prosecute or failure to establish probability of favorable judgment.

Requires at least six months to pass after the lis pendens discharge before a defendant may file the dismissal motion, and the plaintiff must have continued to fail to diligently prosecute the action.

Courts may grant dismissal with prejudice based on the prior lis pendens discharge combined with ongoing failure to prosecute, or for other good cause shown.

Takes effect immediately and applies to both new civil actions filed after the effective date and existing actions not yet finally adjudicated.

Intended to provide property owners faster protection against meritless claims by establishing an expedited path to dismissal when plaintiffs abandon prosecution of their cases.
